Retail Venue
In addition to many services, Socurio acts as a venue to allow users who comply with Socurio’s policies and guidelines to offer, sell, and buy certain original works of art within a fixed price format. Socurio is not directly involved in the transaction between buyers and sellers. As a result, Socurio has no control over the quality, safety, morality or legality of any aspect of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items. Socurio does not pre-screen users or the content or information provided by users. Socurio cannot ensure that a buyer or seller will actually complete a transaction.
Consequently, Socurio does not transfer legal ownership of items from the seller to the buyer. Socurio cannot guarantee the true identity, age, and nationality of a user. Socurio encourages you to communicate directly with potential transaction partners through the tools available on the Site. You may also wish to consider using a third party escrow service or services that provide additional user verification. Socurio does not provide refunds or arbitrate, mediate or otherwise settle disputes between buyers and sellers.
You agree that Socurio is a venue and as such is not responsible or liable for any content, for example, data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links posted by you, other users, or outside parties on Socurio. You use the Socurio venue at your own risk.
User Generated Content
Notwithstanding the following, you acknowledge and agree that Socurio has the absolute right to monitor User Generated Content posted to the Website in its sole discretion. In addition, Socurio reserves the right to alter, edit, refuse to post or remove any such User Generated Content, in whole or in part, for any reason or for no reason, and to disclose such User Generated Content and the circumstances surrounding their transmission to any third party. You agree that we do not have any obligation to use or respond to any User Generated Content.
You agree that you shall immediately notify Socurio in writing of any objectionable content appearing on the Website. Socurio will make good faith efforts to investigate allegations that any User Generated Content violates these Terms of Use but (a) makes no warranty to you that it will edit, remove, or continue to permit the display of any specific User Generated Content, whether or not subject to such allegations, and (b) will have no liability whatsoever for editing, removing, or continuing to permit the display of any User Generated Content whatsoever.
Despite the foregoing, Socurio does not, and you agree that Socurio has no obligation to, review the communications, materials, information, opinions, and other content posted and/or submitted by users accessing the website (including, without limitation, in or on bulletin boards, chat rooms, community pages or other forums on this website) (collectively, "User Generated Content"), that Socurio is not in any manner responsible for User Generated Content, that Socurio does not guarantee the accuracy, integrity or quality of User Generated Content, and that Socurio cannot assure that harmful, inaccurate, deceptive, offensive, threatening, defamatory, unlawful or otherwise objectionable User Generated Content will not appear on the Website. All software used on the Site is the property of Socurio.com or its software suppliers and is protected by United States and international copyright laws.

Certain marks used on the Site are registered trademarks or service marks of Socurio, Inc. or our affiliated companies, in the United States and other countries. Certain graphics, logos, page headers, button icons, scripts, and service names are trademarks, service marks, or trade dress of Socurio.com or our affiliated companies. Our trademarks (including but not limited to: “socurio.com,” “socurio,” “juntos” and “socuriost” trademarks) and trade dress may not be used for any commercial or other purposes by you without our prior written consent. Copyright / Trademark Compliance & Complaints
We honor the intellectual property rights of others. If you believe that your work has been copied or used on the Site in a way that constitutes copyright or trademark infringement, please notify us at legal@socurio.com. Upon receipt of any bona fide claim, or upon becoming aware of any actual or alleged infringement by any other means, we will remove such actual or alleged infringing products from the Site pending our investigation.
Please note that this procedure is exclusively for notifying us of your belief that your copyrighted material or trademark has been infringed and not to be used as a substitute for a cause of action against the infringing party.

Your Account
If you use the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
Meetings & Events
Users may arrange and attend online virtual meetings and events or in-person meetings and events (“Meetings”) with one or more individuals. Users are solely responsible for interactions with others. Users must comply with Socurio’s policies and acknowledge and agree to comply with the laws of the city, county and country in which the Meeting occurs. Additional eligibility requirements for a particular group or Meeting may be set by the group’s contact person. Socurio is not involved with user generated groups, the groups’ requirements, or the Meetings. Socurio does not supervise or control the Meetings, user-initiated online or offline gatherings, or the interactions among and between users and other persons or companies. Users are solely responsible for interactions with others. Users understand that Socurio does not in any way screen its users. All users agree to exercise caution and good judgment in all interactions with others, particularly if meeting offline or in person.
Groups or User Fees
Some user-generated groups on Socurio may require or request that users pay fees in order to be a member of the group, participate in a promotion, or participate in Meetings. SOCURIO IS NOT INVOLED IN THE TRANSACTIONS, THE PAYMENTS OR THEIR PROCESSING. THE PAYMENT DOES NOT GO TO SOCURIO; THIS MONEY IS SEPARATE FROM ANY FEES OR CHARGES ASSESSED BY SOCURIO, AND SOCURIO HAS NO CONTROL OVER THE MONEY, THE USER-GENERATED GROUPS, PROMOTIONS, THE MEETINGS, OR THE LEADER OF THE GROUP IN CONNECTION WITH ITS USE. YOU ACKNOWLEDGE AND AGREE THAT SOCURIO IS NEITHER INVOLVED NOR A PARTY IN ANY PAYMENT, TRANSACTION OR INTERACTION BETWEEN OR AMONG USER-GENERATED GROUPS, SOCURIO USERS AND/OR THIRD PARTIES (together a “Third Party Transaction”), AND THAT YOU BEAR ALL RISK IN CONNECTION WITH YOUR THIRD PARTY TRANSACTIONS. Users should use common sense and be careful in deciding whether to contribute money.
Resolution of Disputes and Release
In the event a dispute arises between you and Socurio, please contact Socurio.
Should you have a dispute with one or more users, or an outside party, you release Socurio (and Socurio's officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. Socurio encourages users to report user-to-user disputes to your local law enforcement, postmaster general, or a certified mediation or arbitration entity, as applicable.
Socurio, for the benefit of users, may try to help users resolve disputes. Socurio does so in Socurio’s sole discretion, and Socurio has no obligation to resolve disputes between users or between users and outside parties. To the extent that Socurio attempts to resolve a dispute, Socurio will do so in good faith based solely on Socurio’s policies. Socurio will not make judgments regarding legal issues or claims.
Breach
Without limiting any other remedies, Socurio may, without notice, and without refunding any fees, delay or immediately remove Content, warn Socurio’s community of a user’s actions, issue a warning to a user, temporarily suspend a user, temporarily or indefinitely suspend a user’s account privileges, terminate a user’s account, prohibit access to the Site, and take technical and legal steps to keep a user off the Site and refuse to provide services to a user if any of the following apply:
Socurio suspects (by information, investigation, conviction, settlement, insurance or escrow investigation, or otherwise) a user has breached this Agreement, the Privacy Policy, the Content Policy, or other policy documents and community guidelines incorporated herein; Socurio is unable to verify or authenticate any of your personal information or Content; or Socurio believes that a user, acting inconsistently with the letter or spirit of Socurio’s policies, has engaged in improper or fraudulent activity in connection with Socurio or the actions may cause legal liability or financial loss to Socurio's users or to Socurio.
No Warranty
SOCURIO, SOCURIO'S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND SOCURIO'S SUPPLIERS PROVIDE SOCURIO'S WEB SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. SOCURIO, SOCURIO'S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND SOCURIO'S SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, PERFORMANCE, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN ADDITION, NO ADVICE OR INFORMATION (ORAL OR WRITTEN) OBTAINED BY YOU FROM SOCURIO SHALL CREATE ANY WARRANTY. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMER MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE.
Limit of Liability
IN NO EVENT SHALL SOCURIO, AND (AS APPLICABLE) SOCURIO'S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR SOCURIO'S SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SITE, SOCURIO’S SERVICES, OR THIS AGREEMENT, INCLUDING WITHOUT LIMITATION, LOST PROFITS, BODILY INJURY, EMOTIONAL DISTRESS, OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
SOCURIO'S LIABILITY, AND (AS APPLICABLE) THE LIABILITY OF SOCURIO'S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAY TO SOCURIO IN THE 12 MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, AND (B) $100. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
Indemnity
YOU AGREE TO INDEMNIFY AND HOLD SOCURIO AND (AS APPLICABLE) SOCURIO'S PARENT, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEYS' FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR BREACH OF THIS AGREEMENT OR THE DOCUMENTS IT INCORPORATES BY REFERENCE, OR YOUR VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY.
No Guarantee
Socurio does not guarantee continuous, uninterrupted access to the Site, and operation of the Site may be interfered with by numerous factors outside Socurio’s control.
Legal Compliance
You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of Socurio’s service and your listing, purchase, solicitation of offers to purchase, and sale of items.
Severability
If any provision of this Agreement is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Agreement shall remain in full force and effect.
No Agency
You and Socurio are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
Reviews, Comments, & Questions
Visitors may send reviews, comments, and other communications, and submit suggestions, ideas, or questions, to support@socurio.com. By doing so, you acknowledge that we will be free to use, disclose, reproduce, modify, license, transfer and exploit any of the foregoing suggestions or ideas in any manner.
Applicable Law
By visiting the site, you agree that the laws of the State of Delaware, without regard to principles of conflict of laws, will govern this Terms of Use agreement and any dispute of any sort that might arise between you and us relating to this agreement.
Modification and Severability
We reserve the right to make changes to our site, policies, and this Terms of Use agreement at any time and in our sole discretion; therefore, you should review our policies, terms, and conditions each time you visit the site. Your continued use of the site after we make any such changes constitutes your binding acceptance of those changes. If any of the terms or conditions herein shall be deemed invalid, void, or for any reason unenforceable, that term or condition shall be deemed severable and shall not affect the validity and enforceability of any remaining term or condition.

Content Policy
About Socurio
Socurio is an artistic gathering place that connects communities through artistic events, mediums and commerce. Socurio is based on the idea that art is fluid, dynamic, practiced and appreciated by people from all demographics. Our vision is to provide a forum for people to collaborate and grow as a person and an artist. But it is not a place for obscene or unlawful images.
Art appreciation is subjective. What may be acceptable to one viewer may be shocking to another. While we recognize the value of thought-provoking artwork that pushes the boundaries of polite society, socurio.com is a public Web site visited by viewers of all ages. Therefore, the images displayed on our site must be respectful of this reality and we reserve the right to prohibit indecent, unlawful or obscene content.
If you feel that your artwork may be inappropriate for a general audience, please do not post it. If you believe that another artist has uploaded an image that violates our content policy, please report it to us at legal@socurio.com. All decisions made by the Socurio Content and Legal team are final and not subject to appeal.
Content Guidelines
Artists must adhere to the following guidelines. We reserve the right to remove any images or other content that may conflict with these guidelines. Gross or repeated violations may result in restrictions on or termination of your account. Also, Artists are reminded that the indemnification provisions of the Artist Agreement require you to bear all responsibility for breaches of these guidelines; in particular, infringement of another party’s intellectual property rights.
• Intellectual property violations. Artists must honor the intellectual property rights of others. Artists shall not post or distribute Artist Content to which they do not own the copyright. In addition, artists shall not post or distribute Artist Content that (i) is an unauthorized reproduction or modified version of a copyrighted work, (ii) features the brand, logo, trademark, trade name or trade dress of any other person or entity, or (iii) infringes any third party’s rights of privacy or publicity. In particular, unless the artist can provide a model release, our practice is to remove celebrity photos and photorealistic paintings and drawings (those that are designed to look like exact replicas of the original work) of celebrities when we become aware of them. If you believe that your artwork has been copied in a way that constitutes copyright and/or trademark infringement, please report it to us at legal@socurio.com.
• Original Work. Artists may only post or distribute Artist Content that is their original work or the original work of a living, contemporary artist with whom the Artist has an agreement to represent the artist. Artists shall not post or distribute Artist Content that they believe is in the “public domain.”
• Illegal Acts. Artists shall not post or distribute Artist Content that would constitute or encourage a criminal offenses, violate the rights of any party, or that would otherwise create liability under or violate any local, state, national or international law.
• Hate and social intolerance. Artists shall not post or distribute Artist Content that contains hate or racial intolerance or advocates violence or ridicule against any individual, group, or organization.
• Illicit drugs and drug paraphernalia. Artists shall not post or distribute Artist Content that displays illegal drugs or the paraphernalia used for them.
• Inappropriate Language. Artists shall not post or distribute Artist Content that features excessive profanity or sexually explicit language, defamatory statements, or remarks that disparage or ridicule other people.
• Pornography. Socurio is not a place for erotica or adult content that crosses the line from art into pornography. Artwork depicting nude figures and affectionate activity are acceptable, however, under no circumstances shall Artists post X-rated or hard-core images, sexual images involving children, images that depict graphic or deviant sexual acts, amateur porn or any paraphernalia involved with this type of activity.
• Violence. We do not ban depictions of violence created with artistic purpose or merit. However, Artists shall not post images that contain overt or gratuitous violence or images of crime-scene photos, morgue shots or violent depictions or human organs and body parts, or images that promote suicide.
• Amateur Photography. Socurio was created for use by amateur and professional artists. While we appreciate everyone’s interest in displaying their artwork on socurio.com, it is not intended as a photo-sharing site for baby pictures, pet pictures, amateur glamour shots, vacation pictures, etc.
• Other harmful or offensive materials. Artists shall not post images that a reasonable art viewer would find offensive or art that (i) is libelous, (ii) promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or otherwise; (iii) is harmful to or exploitative of children; or (iv) is otherwise illegal.
• Misrepresentation. Artists may not falsely state or otherwise misrepresent their affiliation, or affiliation of their Artist Content, with any other person or entity in any way.
• Commercial activity. Artists shall not post or otherwise transmit any unsolicited or unauthorized advertising, personal or business promotional materials, website URLs, e-mail addresses, telephone numbers, software viruses, political campaigning, commercial solicitation, commercial solicitation, mass mailings, “junk mail,” “spam,” “chain letters,” or “pyramid schemes” or other such solicitations.
The list above is not an exhaustive list of unacceptable Artist Content. Rather, it is a set of guidelines for our artists to follow. Socurio will determine, in its sole discretion, whether Artist Content is in compliance with this Content Policy. Socurio reserves the right to finally determine the appropriateness of all images posted to our site.
